Imprint and postal contact details

These Terms govern Moviebase’s apps, website, account and community services provided by the operator identified above (“we”, “us”). They apply alongside the purchase information for any paid feature you select. Read the Privacy Policy for information about personal data; acknowledging that notice is separate from agreeing to these Terms or consenting to optional processing.

The service and eligibility

Moviebase helps you discover and track movies and shows, manage your library and lists, and use community features such as profiles, comments and shared viewing activity. Features vary by app version, platform, subscription and connected service. Moviebase does not provide a right to stream or download a film merely because it appears in the catalogue.

You must be at least 18 years old to use Moviebase. You may use the service for your own lawful purposes subject to these Terms. When these Terms are presented for acceptance, review them before creating an account or contributing content. Mandatory consumer rights are not reduced by these Terms.

Accounts and security

Provide accurate information needed to administer your account and keep your contact details current. You may use a pseudonym publicly. Do not impersonate someone else, misleadingly claim affiliation with Moviebase or another organization, or use a username that infringes another person’s rights. We may require a change to a misleading or abusive username and reasonably restrict reservation or reuse of names to prevent impersonation and abuse.

Protect your sign-in credentials and access to connected accounts. Do not share access in a way that compromises security, access someone else’s account without permission, or evade an account restriction. Tell us promptly if you suspect unauthorized access. You are responsible for your own use and culpable breaches of your security obligations; you are not automatically liable for every unauthorized act by another person.

We may contact you about your account, security, support requests, applicable billing matters or material service changes. We may also send you marketing emails about Moviebase, which you can unsubscribe from at any time; accepting these Terms is not consent to marketing. Marketing choices and the use of contact information are explained in the Privacy Policy.

Your content and permission to operate the service

Your content includes profile text and images, comments, replies, list names/descriptions and other material you submit. You retain your ownership rights. You must have the rights or lawful permission needed to submit it and to grant the limited permissions below, and must respect others’ intellectual property, privacy and personality rights.

You grant us a worldwide, non-exclusive, royalty-free permission to store, reproduce, technically format, transmit and display your content to provide the features you request. This includes hosting with service providers, creating thumbnails, delivering shared links and displaying contributions to the audience allowed by the relevant feature and settings. Where translation is offered and requested, it includes processing and displaying a translation. Providers may exercise these permissions only as necessary to deliver the relevant service on our behalf.

This permission is limited to operating the service, including safety review; it does not transfer ownership or give us a general right to sell your writing. We do not use your comments to train AI models, and this permission does not authorize us or our service providers to use them for AI training. Processing comments for moderation or a requested translation is separate from training a model. Other users may view and use your contributions through the service’s features, but do not acquire unrestricted rights to exploit your work.

When you delete content or close your account, this permission ends except to the extent needed to complete deletion, handle restricted backup copies, comply with legal obligations or establish or defend claims. Those exceptions do not authorize continuing ordinary public display. Lawful copies made independently by others are not within our control. Your feedback about the product may be used to evaluate and develop improvements without a duty to implement it or pay for the idea; this does not assign ownership of all material you send us.

Acceptable use and community rules

The Community Guidelines form part of these Terms. You must not:

  • Post illegal content, threats, harassment, hateful attacks, sexual exploitation material or prohibited sexual or violent imagery.
  • Expose confidential information, doxx another person, impersonate someone, or infringe copyright, privacy or other rights.
  • Post scams, malicious links, unsolicited commercial spam or deceptive endorsements; manipulate ratings, follows or engagement.
  • Misuse reporting tools, deliberately submit false complaints, or retaliate against someone for a good-faith report.
  • Interfere with the service, distribute malware, bypass security/rate limits, or evade restrictions through other accounts.
  • Harvest personal data or use automated access in ways that violate privacy, bypass access controls or impose an unreasonable load. Any expressly authorized API use remains subject to its applicable conditions.

Mark significant spoilers and keep discussions relevant. Discussion of mature or disturbing film themes is not automatically a violation; context and the distinction between discussing fiction and targeting a person matter. User opinions are their own and are not our endorsement.

Reporting, moderation and review

You can report a contribution through available in-app controls or use Report content or request a review. We use reports, technical controls, automated screening where enabled and human review to address violations. Not all content is reviewed before it appears, and automated tools can make mistakes.

Depending on the severity, context and repetition of a violation, we may reject a submission, add or enforce a spoiler marker, remove or restrict content, warn an account, limit a feature, or suspend or terminate access. We consider the interests and rights of those affected. Urgent safety, security or legal grounds may require action without advance notice; otherwise we give an appropriate opportunity to address a remediable breach where required.

Where required, we explain the content or account restriction, the relevant rule or legal basis, the role of automated tools and the available ways to challenge the decision. You can request a review by contacting our legal address and identifying the decision. We will consider the explanation and relevant evidence. Nothing here excludes statutory complaints, judicial remedies or other applicable redress.

Reports are handled with attention to their urgency and the evidence available. We do not offer an emergency service or guarantee round-the-clock monitoring, a particular response time beyond applicable legal requirements, or detection of every violation. If there is an immediate danger, contact the appropriate emergency services.

Copyright and illegal-content notices

Send notices to legal@moviebase.app. Identify the content with its URL or in-app identifier, explain why you believe it is unlawful or infringes your rights, provide supporting details and contact information, and confirm that the information is accurate and complete to the best of your knowledge. Our reporting page explains the information needed for different concerns.

We assess sufficiently precise notices and take action required by applicable law. We may request clarification. Do not knowingly misrepresent a claim. This process does not limit notices or rights available under applicable law.

Privacy choices and third-party services

When you create an account and claim a profile username, the profile is public and activity sharing is enabled by default, which publishes your watched history, ratings, favorites and watchlist. Review the available privacy controls before sharing your viewing records or contributions.

Check the audience before publishing. Public content can be viewed and copied by others, and unlisted links can be forwarded. A private profile does not automatically remove existing comment text. Blocking does not make all public content inaccessible to the blocked person. The visibility explanation describes these distinctions.

Trakt, TMDB, app stores, GIF/media hosts and streaming providers are independent services. Connected synchronization may update data in both Moviebase and the connected service according to the features/settings you use. Review those settings and the provider’s terms. Disconnecting or deleting Moviebase does not automatically remove data held by another provider.

Catalogue metadata, release dates, ratings, translations, availability and external links may be incomplete, inaccurate or change. Check current availability and purchase conditions with the relevant provider. We do not control independent services or guarantee their continued integration. This does not exclude our responsibility for obligations we have undertaken ourselves.

Paid features, subscriptions and refunds

The purchase screen identifies the paid feature, price, billing period and any trial or renewal conditions before purchase. App-store purchases are billed through the relevant Apple or Google account, with purchase and entitlement administration supported by RevenueCat. We do not require direct payment-card details or issue manual fallback invoices for those purchases.

Subscriptions renew according to the conditions presented at purchase unless cancelled in the store’s subscription settings. Cancel before the renewal deadline shown by the store to avoid the next charge. A trial converts to paid access only under the conditions disclosed when you accept the offer. We do not retroactively change an accepted trial offer through these Terms.

Manage cancellation, billing and store refund requests through the store that processed payment. You can also contact us about a defective or missing feature. Store processes do not remove mandatory rights against us, including any applicable withdrawal, repair, price-reduction, refund or termination rights. Starting a download alone is not a blanket waiver of statutory withdrawal rights.

Deleting an account or uninstalling Moviebase does not itself cancel a store subscription. Fee changes apply only with the notice, consent and cancellation protections required by the purchase terms and applicable law. Continued use alone is not deemed consent where affirmative agreement is required.

Availability, updates and changes to features

We maintain the service with reasonable care. Maintenance, faults and events outside our reasonable control can interrupt availability. We do not promise uninterrupted access or compatibility with every device. This does not remove required updates, contractual performance obligations or statutory remedies.

We may change features for valid reasons such as security, legal requirements, necessary technical compatibility or changes in third-party integrations. Changes to continuously supplied digital products beyond what is needed to maintain conformity are subject to applicable legal conditions, including no additional cost for such a change and clear information. Where a change materially impairs access or use, we provide advance information on a durable medium and explain applicable termination rights, including the statutory 30-day right where it applies. We will not rely on this clause to remove mandatory protections.

If a service is to be discontinued, we provide reasonable advance notice where feasible and legally required, with information about available data retrieval and paid-service remedies. Keeping your own export of important library records is sensible; it is not a waiver of our responsibility for data loss attributable to us.

Ending use, deletion and restrictions

You may stop using Moviebase at any time. To delete your account and associated data, initiate deletion in the app or follow the account-deletion instructions. Merely signing out or ceasing use does not delete an account. Export records you want to keep before deletion.

Deletion can remove profile information, contributions and the discussions attached to deleted parent comments or lists. Separate retention exceptions and processing across systems are described in Privacy. Cancellation of a paid subscription is separate.

We may terminate or restrict access for a serious or repeated breach or where necessary for legal, security or safety reasons, subject to the process above and applicable notice/remedy requirements. We will not exclude a refund or other remedy that law requires. Provisions that by their nature must continue, such as lawful retention, accrued payment obligations and dispute rights, remain applicable to that extent.

Liability and mandatory rights

We are liable without limitation for intent and gross negligence, for culpable injury to life, body or health, under any guarantee we expressly assume, and where liability cannot lawfully be limited, including applicable product-liability rules. Mandatory data-protection liability and consumer remedies remain unaffected.

For ordinary negligence, we are liable for breach of an essential contractual obligation, limited to loss that was foreseeable and typical for this contract when it was made. An essential obligation is one whose performance makes proper delivery of the service possible and on which you can ordinarily rely. Liability for ordinary negligence in other cases is excluded only to the extent permitted by law and subject to the preceding paragraph.

These limits also apply to our personnel and persons assisting us in performance, to the extent lawful. Your own responsibility for unlawful conduct is determined by applicable law.

Governing law, disputes and language

German law applies, excluding its conflict-of-laws rules, but consumers retain mandatory protections of the law of their habitual residence where applicable. These Terms do not impose an exclusive court on consumers or require arbitration. You may contact us to resolve a concern, but doing so is not a prerequisite to legal proceedings. If a provision of these Terms is invalid, the remaining provisions stay effective.

Translations are provided for accessibility. If wording differs, English may help explain the intended meaning, but this does not override mandatory consumer protections or a language/version legally agreed with you.

Changes to these Terms

We explain material proposed changes and make reasonable efforts to give at least 30 days’ advance notice before they take effect, consistent with our existing notice commitment, unless a shorter period is required by law or necessary to address an urgent security issue. Any applicable longer notice period or consent requirement still applies.

We seek agreement where required rather than treating silence or continued use as universal consent. If you do not agree, we explain your options for ending the affected service and any applicable data-retrieval or paid-service remedies. A Terms update is separate from a Privacy Policy update and from optional consent choices.
